SEW-EURODRIVE Kft. (hereinafter “SEW-EURODRIVE Kft.”) interacts with personal data in the course of its purchases, services and marketing activities and when filling open positions. - 1. The purpose of processing personal data and the legal basis for the processing in the context of the conclusion and performance of contracts
Prior to the conclusion of the contract, contact may be made by telephone, fax, email or via the website of SEW-EURODRIVE Kft. The purpose of processing prior to entering into a contract is to take steps at the request of the partner or supplier prior to entering into a contract (including the submission of an offer) pursuant to Article 6(2)(b) of the GDPR.
After the conclusion of a contract, the purpose of processing related to the contract is the performance of the contract or compliance with a legal obligation to which the controller is subject, the legal basis being performance of the contract or compliance with a legal obligation pursuant to Article 6(1)(b) and (c) of the GDPR.
SEW-EURODRIVE Kft. processes the data provided during the order for the purpose of performing the contract and, where applicable, engages specialised and supervised service providers for this purpose. In addition, SEW-EURODRIVE Kft. may use the data necessary for the preparation of the offer in the context of funding requests and, if necessary, transmit them to the contracting partners. The legal basis for processing related to a contract, in relation to the representative and contact person signing the contract on behalf of the legal person as a partner and participating in the performance, is the legitimate interest of SEW-EURODRIVE Kft. and the legal person as a partner pursuant to Article 6(1)(f) of the GDPR.
SEW-EURODRIVE Kft. processes the data of third parties necessary for the performance of the contract on the legal basis of legitimate interest (Article 6(1)(f) of the GDPR).
It is in the legitimate interest of SEW-EURODRIVE Kft. and the legal entity as partner that the contract is performed smoothly, and for this purpose it is necessary to ensure regular contact and the possibility of making enquiries, both with regard to the representative and contact person of the legal entity as partner and with regard to third parties necessary for the performance of the contract. SEW-EURODRIVE Kft. has carried out the “balancing of interests test” with regard to the processing of data necessary for the exercise of its legitimate interests.
SEW-EURODRIVE Kft. processes the data relating to the product that is the subject of the contract and the data that is necessary to take further steps to enforce the claim (initiate enforcement) in the event of possible non-performance of the contract, on the legal basis that it is necessary to enforce the legitimate interests of the Controller. SEW-EURODRIVE Kft. has carried out the “balancing of interests test” with regard to the processing of data necessary for the exercise of its legitimate interests.
SEW-EURODRIVE will store the data collected for the purpose of performing a contract in its operating system for as long as the warranty claims or other purposes stated in this statement are valid. All data will be deleted directly, unless further purposes for the use of the data have been specified in this statement. The processing is based on Article 6(1) lit. b GDPR with regard to warranty claims and on Article 6(1) lit. c GDPR with regard to legal obligations. - 2. The contract may include sending newsletters and event invitations to the partner, and the legal entity’s (partner’s) representative and contact person.
