Personal data means any information relating to an identified or identifiable natural person (hereinafter the “Data Subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

SEW-EURODRIVE Kft. (hereinafter “SEW-EURODRIVE Kft.”) interacts with personal data in the course of its purchases, services and marketing activities and when filling open positions. When processing the personal data of natural persons, SEW-EURODRIVE Kft. acts in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter “GDPR”) and other applicable national legislation.

SEW-EURODRIVE Kft. regularly checks that its data protection practices comply with relevant law and responds responsibly to these obligations, in particular with regard to the privacy of individuals and the protection of data. It also provides the necessary protection for third parties who cooperate with SEW-EURODRIVE Kft.


This notice contains information on data protection in connection with the services SEW-EURODRIVE Kft. provides.

    SEW-EURODRIVE Kft. has assessed the need to appoint a data protection officer and concluded that the cases set out in Article 37 (1) of the GDPR do not apply.     If, at a later stage, SEW-EURODRIVE Kft. decides to appoint a data protection officer, it will inform you about this in due time.

  • III. DATA PROCESSING IN CONNECTION WITH THE DRAFTING OF OFFERS, ENTERING INTO AND PERFORMANCE OF CONTRACTS, COMPLIANCE WITH TAX AND ACCOUNTING OBLIGATIONS, SENDING OF NEWSLETTERS AND INVITATIONS TO EVENTS, OR MAKING CONTACT VIA THE WEBSITE
    • 1. The purpose of processing personal data and the legal basis for the processing in the context of the conclusion and performance of contracts

      Prior to the conclusion of the contract, contact may be made by telephone, fax, email or via the website of SEW-EURODRIVE Kft. The purpose of processing prior to entering into a contract is to take steps at the request of the partner or supplier prior to entering into a contract (including the submission of an offer) pursuant to Article 6(2)(b) of the GDPR.

      After the conclusion of a contract, the purpose of data processing related to the contract is the performance of the contract or compliance with a legal obligation to which the controller is subject, the legal basis being performance of the contract or compliance with a legal obligation pursuant to Article 6(1)(b) and (c) of the GDPR.

      SEW-EURODRIVE Kft. processes the data provided during the order for the purpose of performing the contract and, where applicable, engages specialised and supervised service providers for this purpose. Processing of data during the performance of a contract includes the use of data for the performance of services under the contract, including the performance of servicing activities under service contracts or the processing of any warranty claims. In addition, SEW-EURODRIVE Kft. may use the data necessary for the preparation of the offer in the context of funding requests and, if necessary, transmit them to the contracting partners. Further details on the purposes are set out in the relevant contractual document. These processing operations are based on the first sentence of Article 6(1) lit. b) of the GDPR.

      The legal basis for the data processing related to a contract, in relation to the representative and contact person signing the contract on behalf of the legal person as a partner and participating in the performance, is the legitimate interest of SEW-EURODRIVE Kft. and the legal person as a partner pursuant to Article 6(1)(f) of the GDPR.

      SEW-EURODRIVE Kft. processes the data of third parties necessary for the performance of the contract on the legal basis of legitimate interest (Article 6(1)(f) of the GDPR).

      It is in the legitimate interest of SEW-EURODRIVE Kft. and the legal entity as partner that the contract is performed smoothly, and for this purpose it is necessary to ensure regular contact and the possibility of making enquiries, both with regard to the representative and contact person of the legal entity as a partner and with regard to third parties necessary for the performance of the contract. SEW-EURODRIVE Kft. has carried out the “balancing of interests test” with regard to the processing of data necessary for the exercise of its legitimate interests.

      SEW-EURODRIVE Kft. processes the data relating to the product that is the subject of the contract and the data that is necessary to take further steps to enforce the claim (initiate enforcement) in the event of possible non-performance of the contract, on the legal basis that it is necessary to enforce the legitimate interests of the Controller. SEW-EURODRIVE Kft. has carried out the “balancing of interests test” with regard to the processing of data necessary for the exercise of its legitimate interests.

      SEW-EURODRIVE will store the data collected for the purpose of performing a contract in its operating system for as long as the warranty claims or other purposes stated in this statement are valid. All data will be deleted directly, unless further purposes for the use of the data have been specified in this statement. The processing is based on the first sentence of Article 6(1) lit. b) of the GDPR with regard to warranty claims and on the first sentence of Article 6(1) lit. c) of the GDPR with regard to legal obligations.
    • 2. The purpose of processing personal data and the legal basis for the processing in the context of newsletters

      The contract may include sending newsletters and event invitations to the partner, and the legal entity’s (partner’s) representative and contact person. The legal basis for data processing in this case is the prior consent of the Data Subject pursuant to Article 6(1)(a) of the GDPR.
    • 3. The purpose of processing personal data and the legal basis for the processing in the context of the fulfilment of tax and accounting obligations (accounting, taxation)

      SEW-EURODRIVE Kft. processes the personal data contained in the tax and accounting documents related to the contract on the legal basis of compliance with a legal obligation, for the purpose of compliance with statutory tax and accounting obligations (accounting, taxation) (Article 6(1)(c) of the GDPR).
    • 4. Affected Data Subjects

      Natural persons, representatives and contact persons of legal entities interested in the services of SEW-EURODRIVE Kft. or entering into a contract with SEW-EURODRIVE Kft., including third parties necessary for the performance of the contract.
    • 5. Scope of data processed

      The name, address or contact address of the Data Subjects (including the registered office or place of business of the legal entity employing the representative or contact person), telephone number, email address, fax number, and other personal data provided by the Data Subject for the purposes of submitting the offer, concluding and performing the Services Contract, and other personal data contained in documents required for compliance with tax and accounting obligations (e.g. tax number).

      SEW-EURODRIVE Kft. processes the data received in the context of your requests or your contractual relationship with us. This includes in particular, in addition to contact details, any information exchanged, such as emails, orders, requests related to our products, and payment dates.
    • 6. The recipients or categories of recipients of the personal data

      The representatives of SEW-EURODRIVE Kft. are the employees who perform tasks related to the servicing of partners and suppliers.

      The personal data may be disclosed to persons involved in the performance of the contract or to other persons used in connection with the performance of the contract whose involvement or use has been approved by the partner.

      The recipients of the personal data contained in the documents for compliance with tax and accounting obligations are the employees and processors of SEW-EURODRIVE Kft. who perform tax and accounting tasks.

      The data collected by SEW-EURODRIVE Kft. on the purchase of its products or the use of its services may be transmitted to SEW-EURODRIVE Kft’s external auditors and/or tax consultants for advisory and investigative purposes.

      The data is transmitted for processing to the person providing archiving, accounting and, in the case of electronic communication, IT services to SEW-EURODRIVE Kft. In the case of postal delivery, the address data is transmitted to Magyar Posta (the Hungarian Post Office) or the contracted courier service.

    • 7. Envisaged period of storage of personal data or, if not possible, the criteria used to determine that period

      The period of storage of personal data is 1 year from the date of the last contact in the case of no contract, 5 years after the termination of the contract in the case of a contract, and 1 year after the termination of the contract for newsletters and event invitations, unless the partner gives consent to further processing.

      The period of storage of the data processed to comply with tax and accounting obligations is 8 years after the termination of the contract.

      If more than one period applies to the storage of the data, the longer period prevails.

    • 8. Information on whether the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract, and whether the Data Subject is obliged to provide the personal data, and information on the possible consequences of failure to provide such data

      The provision of data to SEW-EURODRIVE Kft. is not a statutory or contractual requirement, but the provision of data relating to entering into a contract is a requirement necessary to enter into the contract. The Data Subject is not obliged to provide the personal data, but failure to do so may result in failure to successfully contact SEW-EURODRIVE Kft., to receive an offer, to enter into a contract, or to send newsletters or invitations to events.

Sections 9-16 below provide additional information for visitors to the website:

    • 9. Types of automatically collected data

      When you access our website, general information is automatically recorded. This information (server log files) includes the type of browser, the operating system used, the domain name of your internet service provider and other similar information. In addition, the IP address is transmitted and used to access the service you have requested. This information is technically necessary in order to correctly display the requested content of websites and is mandatory when using the internet. We anonymise or delete this log file data as required. The legal basis for the processing is the first sentence of Article 6(1) lit. of the GDPR.

      If you use services offered on our website, we may also collect additional personal data about you. We process this personal data to the extent necessary to provide the services you have requested. You may also provide additional personal data on a voluntary basis. We describe the legal basis in the functions and offerings individually presented below. We will treat your data as confidential and delete or block it within the limits of the law.

      If you send us a request by email, we will collect the data you provide us for the purpose of processing your request and we will fulfil your request, if applicable. The legal basis for this in both cases is the first sentence of Article 6(1) lit. f) of the GDPR.

      Your data will not be processed by other companies or by us for any other purpose, except for the uses set out below, unless a statutory authorisation applies or you have given your consent..

      We take technical and operational security measures on our websites to protect the personal data we store from being accessed by third parties, as well as to prevent loss or misuse and to enable secure data transfer.

      We should point out that, due to the way the internet is structured, unintentional data access by third parties may occur. It is therefore also your responsibility to protect your data from being misused by encrypting it or by using any other appropriate method. Without the right security measures, data that is transmitted without encryption, including by email, may be read by third parties.

      You can contact us regarding any issue by visiting our online support account at https://www.sew-eurodrive.hu/hu_hu/online_support/ Once you register, you will have access to many functions and services provided by SEW-EURODRIVE Kft. The processing purposes and processed data can be ascertained from the individual functions, e.g. drawing up sales contracts, requesting delivery status, or carrying out troubleshooting.

      The legal basis for registering with the online support is the first sentence of Article 6(1) lit. f) of the GDPR. For the assignment of specific services and the further processing of your data e.g. to optimise our online support platform and improve your customer experience, please refer to Section 14 (1) b) “Compilation of usage statistics by SEW-EURODRIVE” and Section III.

            The data thus generated is processed and stored by etracker on our behalf exclusively in Germany and is therefore subject to the strict German and European data protection laws and standards. In this respect, etracker has been independently checked, certified, and awarded the privacy seal ePrivacyseal.

            The data is processed on the basis of the legal provisions of Article 6(1)(f) (legitimate interests) of the EU General Data Protection Regulation (GDPR). Our objective is to analyse the use of our website and to optimise our online offering and our website in order to make them more interesting for you as a user by means of the statistics obtained, in which we also have a legitimate interest.

          • (b) Creation of utilisation statistics by SEW-EURODRIVE Kft.

            We use a tool, which has been developed in-house, to analyse and regularly improve the use of our website and our Online Support Portal. Through the statistics we receive, we can improve and make our offer more interesting to you as a user. We do not process your name and IP address during these analyses.

            If you are not logged in as a customer, we are not able to identify you using the data and information listed below. A cookie is placed on your device (browser) and a random session ID is assigned to it. The following information is processed in this cookie:

            • Screen size
            • Screen resolution
            • Type of device
            • Operating system and version
            • Browser
            • Information as to whether cookies are activated in the browser
            • Geo data (continent, country, region, city)
            • Timestamp (date, time of login)
            • “Click data” (individual applications accessed)
            • Search queries
            • “Abandoned shopping carts” (product placed in the shopping cart but not ordered)
            • Bandwidth and internet provider

            We do this to analyse whether users who are not logged in as customers are using our online support offer and, if so, how.

            In order to optimise the Online Support platform and improve your customer experience we analyse the following data, in addition to the aforementioned, if you are logged into our Online Support as a customer. This data is used only internally at SEW-EURODRIVE Kft. and without processing your name or your IP address:

            • your role at the company
            • registration date
            • company name, legal entity, account number
            • company type
            • purchase order name
            • eligibility for the net price
            • sales organisation

            The information recorded and analysed is stored exclusively on our servers in Germany provided it is needed for the analysis and optimisation of Online Support and only for as long as it is needed for this purpose. However, the data is stored and processed for a maximum of 5 years.

            The legal basis for recording and creating the analyses is Article 6(1)(f) of the GDPR. If you do not want any analyses performed during use of the Online Support via your device, you can object to tracking with the SEW EURODRIVE Kft. tool here.

        • (2) Use of cookies for advertising purposes

          We use cookies for marketing purposes to tailor advertising to a website visitor’s interests. They are also used to limit the frequency of advertisements and measure the effectiveness of the advertisement. This is how we collect information on which websites and articles were clicked on. In this way, we can collect information on usage patterns in order to balance interest-based advertising. This information can be shared with third parties through the advertising networks used. In these cases, the cookies are regularly set directly by the advertising partner.

          The following cookies are specifically set for advertising purposes:
          • (a) Use of Google Remarketing

            We use Google Adwords to draw attention to our attractive offers through advertising material on external websites (Google Ads). These advertising materials are delivered by Google through ad servers. This is done using ad server cookies, which allow the evaluation of performance parameters such as ad impressions, clicks and conversions. In this way, we can determine how successful each advertising measure is compared to the data of the advertising campaigns. If you access our website via a Google advertisement, Google Adwords will store a cookie on your device. These cookies usually loose their validity after 30 days and cannot identify you personally. The following analysis values are usually stored with this cookie:

            • Number of ad impressions per placement (frequency)

            • Opt-out information (marking that the user no longer wants to be addressed)

            These cookies allow Google to recognise your web browser. If a user visits specific pages of a website operated by an AdWords customer and the cookie stored on their device has not yet expired, Google and the customer will be able to see that the user has clicked on the advertisement and was redirected to that page. Every AdWords customer is assigned a different cookie. Cookies cannot therefore be tracked via the websites of AdWords customers. We ourselves do not collect and process any personal data through the above-mentioned advertising measures. We only receive statistical evaluations from Google. Through these evaluations, we can identify which of the advertising measures used are particularly effective. We do not receive any other data about the use of advertising materials, and in particular we cannot identify any users based on this information. The legal basis for the processing is the first sentence of Article 6(1) lit. a) of the GDPR (consent of the data subject).             Based on the marketing tools used, your browser automatically establishes a direct connection to the Google server. Please note that processing by Google may also take place outside the European Union. Beyond that, we have no control over the scope and further use of the data collected by Google through the use of this tool. We therefore inform you based on our current knowledge that:

            By using “tracking tools”, Google receives the information that you have accessed our website’s corresponding page or you have clicked on an advertisement from us. If you are registered with a Google service, Google may associate the visit with your account. Even if you are not registered with Google or have not logged in, there is a chance that the provider will find out and store your IP address. Through the company’s remarketing technology, users who have already visited our website and online services and are interested in our offers are re-targeted with advertising on Google Partner Network pages.             We also use the Google Remarketing application. This is about remarketing in order to deliver interest-based advertising. This application allows us to display our ads to you when you visit other websites after you have visited our website. According to its own statements, Google does not combine the data collected in the course of remarketing with your personal data that Google may store.           • (b) Use of Marketo

            Our website uses Marketo Inc. (“Marketo”) services. This involves the use of cookies that are stored on your device and that enable the analysis of your use of the website.

            For this purpose, a profile is created under a pseudonym and your IP address is immediately anonymised. Analysis of website usage is used to display usage-related content and interest-based advertising.

            The information generated by cookies about your use of this website is transferred to a Marketo server within the EU on our behalf and stored there. In some cases, data may also be transferred to servers in the USA and stored there for advertising purposes. To ensure an adequate level of data protection, Marketo has subjected itself to the European Commission’s decision on standard contractual clauses for the transfer of personal data to companies operating in countries outside the EU.

            The processing is based on the first sentence of Article 6(1) lit. a) of the GDPR (consent of the data subject). Users can give their consent by clicking on a pop-up window when entering the site.

            Our objective is to analyse the use of our website and to optimise our online offering and website and to use these analyses to make them more interesting for you as a user, which is also our legitimate interest under the GDPR.

    • 15. Involvement of external service providers
      • a) Embedding of YouTube videos on our website

        On individual websites, we have embedded YouTube videos that are stored on http://www.youtube.com and can be played directly from our website. These videos are embedded in “extended data protection mode”, i.e. no data about you as a user will be transmitted to YouTube if you do not play the videos. The data below is only transmitted when you play the videos. We have no influence on data transmission.

        By playing the embedded videos, YouTube receives the information that you have accessed the corresponding page on our website, and additional data may be transmitted to YouTube of which we are not aware. This happens whether of not you have YouTube account to which you are logged in. If you are logged in to YouTube, your data will be directly assigned to your account. If you do not want it to be assigned to your YouTube profile, you must log out before activating the button. YouTube saves your data as a user profile and uses it for the purposes of advertisements, market research and/or demand-based design of its website. Such an evaluation may take place especially for providing on-demand advertisements (even to non-logged-in users) and to inform other YouTube users about your activities on our website. You have the right to object to the creation of user profiles, although you must contact YouTube to exercise this right.

The provider of this site has no influence on this data transmission. If you are signed in to your Google Account, Google may combine your usage data with other data and associate it with your account.         For these information services, we use the technical platform and services of the providers. Please note that you use the features of social media platforms at your own risk. This applies, in particular, to the use of interactive functions (e.g. comments, sharing and rating). When you visit our social media pages, the social media platform providers record, among other things, your IP address as well as other information which is available on your terminal equipment in the form of cookies. This information is used to provide us with statistical information, such as the account operators’ interactions with us.

        Your data may be transferred to the United States. It is not known to us how social media platforms use data from our account visits and interactions with our posts for their own purposes, how long they store this data and whether they transfer it to third parties. The processing may vary depending on whether you are registered and logged into the social network in question or only visiting the site as a non-registered and/or non-logged-in user.

        When you access a post or account, the IP address assigned to your terminal equipment is forwarded to the social media platform provider. If you are logged in as a user, using the cookie on your device allows how you have moved around the network to be tracked. To avoid this, log out, delete the cookies on your device and restart your browser.

        In addition to this, we, as the provider of the information service, only collect and process the data from your use of our service that you provide to us and that is necessary for an interaction. For example, if you ask a question that we can only answer by email, we will store your data in accordance with our general data processing principles, which are described in this privacy statement. The legal basis for processing your data on social media platforms is the first sentence of Article 6(1) lit. f) of the GDPR.

        To exercise your rights as a Data Subject, you can contact either us or the social media platform provider. If a party is not able to answer the question or needs information from the other party, we or the service provider will forward your request to the competent partner. If you have any questions about profiling or the processing of your data when using the website, please contact the social media platform provider directly.   • IV. PROCESSING ACTIVITIES OF SEW-EURODRIVE KFT. WITH REGARD TO THE PROCESSING OF JOB APPLICANTS’ DATA

    • 1. The purpose of processing personal data and the legal basis for the processing

      To select an employee with suitable qualifications and practical knowledge for the member of SEW-EURODRIVE Kft. with an open position, to fill the open position and to enter into an employment contract with the selected employee.

      The legal basis for the processing is steps taken at the request of the Data Subject prior to entering into an employment contract, pursuant to Article 6(2)(b) of the GDPR.
    • 2. Affected Data Subjects

      Applicants for open positions at SEW-EURODRIVE Kft.
    • 3. Scope of data processed

      The Data Subjects’ name, date and place of birth, mother’s maiden name, address, qualifications, photograph, telephone number, email address, other information provided by the applicant in his or her CV and employer’s reference (if any).
    • 4. The recipients or categories of recipients of the personal data

      Representatives of a member of SEW-EURODRIVE Kft. with an open position, managers who are entitled to exercise employer rights, and employees with labour relations.

      The data is transmitted for processing to the person providing IT services to SEW-EURODRIVE Kft. in the case of electronic communication. In the case of postal delivery, the address data is transmitted to Magyar Posta (the Hungarian Post Office) or the contracted courier service.
    • 5. Envisaged period of storage of personal data or, if not possible, the criteria used to determine that period

      SEW-EURODRIVE Kft. will keep the personal data until the application has been assessed, and will delete the personal data of applicants who are not selected and any applicants who withdraw their applications.

      SEW-EURODRIVE Kft. may only retain the applications on the basis of the express, unambiguous and voluntary consent of the Data Subject, provided that their retention is necessary for the purposes of data processing in accordance with the law. SEW-EURODRIVE Kft. will request this consent from the applicants after the recruitment process has closed.
    • 6. Information on whether the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract, and whether the Data Subject is obliged to provide the personal data, and information on the possible consequences of failure to provide such data

      The provision of data to SEW-EURODRIVE Kft. is not a statutory or contractual requirement, but the provision of data is a requirement necessary to enter into an employment contract with the applicant. The Data Subject is not obliged to provide personal data, but failure to do so may result in the applicant not being selected to fill the open position.
  • V. OTHER INFORMATION

    • 1. Transfers to third countries or international organisations

      SEW-EURODRIVE Kft. does not transfer data to third countries or international organisations. If, however, personal data is transferred to a third country or an international organisation, SEW-EURODRIVE Kft. will ensure that the rules on guarantees set out in Chapter V of the GDPR are complied with.
    • 2. Rights of the Data Subject

      In order to exercise the rights set out below, the Data Subject may contact SEW-EURODRIVE Kft. at the contact details set out in Section I.

      • 2.1. The Data Subject’s right of access

        The Data Subject has the right to receive feedback from SEW-EURODRIVE Kft. as to whether or not his or her personal data is being processed and, if such processing is taking place, the right to access the personal data and the information specified in Article 15 of the GDPR.
      • 2.2. Right to rectification

        The Data Subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the Data Subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
      • 2.3. Right to deletion

        The Data Subject shall have the right to obtain from the controller the deletion of personal data concerning him or her without undue delay, and the controller shall have the obligation to delete personal data without undue delay where one of the following grounds applies:
        • a) the personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed;
        • b) the data subject withdraws consent on which the processing is based and there is no other legal ground for the processing;
        • c) the Data Subject objects to the processing based on legitimate interest and there are no overriding legitimate grounds for the processing, or the Data Subject objects to the processing in connection with the sending of newsletters or invitations to events;;
        • d) the personal data has been unlawfully processed;
        • e) the personal data has to be deleted in order to comply with a legal obligation based on European Union or Member State law to which the controller is subject.
      • 2.4. Right to restriction of processing

        The Data Subject shall have the right to obtain from the controller restriction of processing where one of the following applies:
        • a) the accuracy of the personal data is contested by the Data Subject, for a period enabling the controller to verify the accuracy of the personal data;
        • b) the processing is unlawful and the Data Subject opposes the deletion of the personal data and requests the restriction of its use instead;
        • c) the controller no longer needs the personal data for the purposes of processing, but it is required by the Data Subject for the establishment, exercise or defence of legal claims; or
        • d) the Data Subject has objected to processing, except for processing related to the sending of newsletters or invitations to events, pending verification of whether the legitimate grounds of the controller override those of the Data Subject.
      • 2.5. Right to data portability

        The Data Subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit this data to another controller without hindrance from the controller to which the personal data have been provided, where the processing is based on consent or on a contract and the processing is carried out by automated means.
    • 3. Information on processing based on consent

      SEW-EURODRIVE Kft. processes the data of job applicants on the basis of consent in accordance with Section IV. Where processing is based on consent, the Data Subject shall have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. The right to withdraw consent can be exercised by contacting us at the contact details set out in Section I.
    • 4. Right to lodge a complaint with a supervisory authority

      The Data Subject has the right to lodge a complaint with a supervisory authority (National Authority for Data Protection and Freedom of Information, postal address: 1530 Budapest, Pf.: 5.; email: ugyfelszolgalat@naih.hu ; telephone: +36-1-391-1400) if he or she considers that the processing of personal data relating to him or her is unlawful or infringes the GDPR.

    • 5. Information on automated decision-making

      There is no automated decision-making at SEW-EURODRIVE Kft.

      In processing personal data, SEW-EURODRIVE Kft. complies with the principles set out in Article 5 of the GDPR.
